Northern California Man Faces Murder Charge in Son’s DUI Death

A Napa County man was charged with murder on July 22 after authorities alleged he was driving while intoxicated when his 10-year-old son died in a vehicle accident in Northern California.

District Attorney Allison Haley filed numerous additional felony charges against Aaron Brian Kennedy, 35, of Angwin, including gross vehicular manslaughter while intoxicated, driving under the influence (DUI) causing injury, and driving with a .08 percent blood alcohol content causing injury with a prior conviction.

The California Highway Patrol (CHP) said Kennedy was driving with his son at about 4:40 p.m. on July 18 when he crashed a 2010 Toyota Corolla head-on into a 2013 Nissan Sentra near Chiles Pope Valley Road and Barnett Road, in Pope Valley—about 80 miles north of San Francisco, according to local news site KRON.

Authorities suspected that Kennedy was under the influence at the time of the collision, reported the media outlet.

Kennedy was flown by helicopter to a nearby hospital after suffering major injuries and was arrested for suspected DUI, the CHP said.

Kennedy’s son, Aiden, was fatally injured during the collision, said the District Attorney’s office. The other driver sustained minor injuries.

Prosecutors in California can pursue second-degree murder charges in some fatal DUI-related accidents under a California Supreme Court ruling from 1983. The ruling allows for a murder charge when a person’s death results from a drunk driver’s actions in certain circumstances, such as when the driver has previously been convicted of DUI.

Other charges filed against Kennedy include child abuse; assembly, maintenance, or placement of a booby trap; and a misdemeanor count of being an unlicensed driver.

Kennedy also faces other serious allegations that, if he is convicted, could add to the severity of his sentence. He had two prior DUI convictions at the time of the crash; his son was under the age of 14; the crash caused injuries to more than one victim; it involved a vulnerable victim and violence, cruelty, viciousness or callousness; the driver was in position of trust; and that the crimes reveal an increasing level of seriousness from past crimes.

Kennedy is currently recovering from his injuries at the hospital, according to the district attorney’s office. He is being held without bail.

A hearing is set for July 25.

Kennedy’s defense attorney could not be reached for comment by The Epoch Times.

The crash remains under investigation, according to authorities.
