Two men have been arrested and charged in the fatal shooting of a man as he was eating at an L.A. Live restaurant in November, the district attorney’s office said March 28.
Philip Pasco Clark, 33, of Los Angeles and Santana Jermaine Kelly, 49, of Palmdale were taken into custody March 22 by Los Angeles police on suspicion of killing Sidney Barrett Morris, the D.A.’s statement said.
The incident occurred Nov. 28, 2023, around 6:15 p.m. at the Fixins Soul Kitchen restaurant, part of the L.A. Live entertainment complex located at 800 West Olympic Boulevard.
Clark allegedly entered, walked straight toward the victim, who was eating alone at the counter, and fatally shot him, the statement said.
Clark fled in a vehicle driven by an unknown person. Mr. Morris died instantly.
“The victim, Sidney Barrett Morris, had dedicated his life’s work to fostering inclusivity and harmony within our society, making his untimely death all the more devastating,” District Attorney George Gascón said in the statement.
Authorities said Kelly allegedly helped plan the killing by providing supplies and support, then tried to destroy evidence by setting fire to the getaway car a day later.
Each man faces one count of murder and one count of conspiracy to commit a crime, while Kelly faces an additional felony count of arson on property of another, according to the statement. Both suspects pleaded not guilty at their March 26 arraignment. If convicted, both could face life in prison.
Both men are being held on bail, with Kelly’s being set at $3.06 million and Clark’s at $4.06 million. They are scheduled for a preliminary hearing on April 25, 2024.
“I want to express my sincere condolences to Mr. Morris’ family,” Mr. Gascón said. “The brazenness of this shooting is alarming, and my office is fully committed to bringing accountability to those responsible for this heinous crime.”
