The Department of Education (DOE) has opened a Title IX investigation due to alleged misuse of girls-only spaces in a New Hampshire school district.
According to the department’s Office for Civil Rights, there has been concern that the Contoocook Valley School District in Peterborough, New Hampshire, has been allowing boys to use the girls’ restrooms and locker rooms.
The office is investigating whether the school’s actions violated Title IX of the Education Amendments of 1972 by allegedly allowing both males and females into areas that are intended to be protected spaces.
Title IX is a federal civil rights law that prohibits sex-based discrimination in education programs or activities that receive federal funding. It requires schools to provide equal opportunity to all students, regardless of gender, across the span of federally funded programs.
It is frequently applied to sexual harassment and assault cases in educational settings.
“Young women should never feel unsafe or uncomfortable in their intimate spaces because their school leaders care more about gender ideology than protecting girls’ dignity and privacy,” Assistant Secretary for Civil Rights Kimberly Richey said.
“Placing the burden on girls to move out of their own intimate spaces when there is a male present is not just absurd, it also discriminates against girls. The Trump Administration will always stand up for these students, investigate disturbing complaints such as this fully, and enforce Title IX to ensure that women and girls are safe when they are at school.”
The investigation stemmed from a complaint filed by the nonprofit Defending Education.
The complaint outlined evidence that the district allowed transgender-identifying males to use restrooms and locker rooms that correspond to their preferred gender identity rather than their biological sex.
Defending Equality also asserted that the school district leadership “has specifically stated that it will apply New Hampshire state law and [Contoocook Valley School] district policy to allow biological males in girl-only spaces like locker rooms and bathrooms regardless of any objections from the biological females who use those spaces.”
The Epoch Times sent a request for comment to Contoocook Valley School District about the investigation but did not immediately receive a response.
New Hampshire isn’t the only location under the microscope in recent weeks. A similar investigation was launched into the New Richmond School District in Wisconsin on March 5.
The Office for Civil Rights said it plans to assess whether the district violated Title IX by allowing students to use intimate facilities “based on ‘gender identity,’ not biological sex.”
That investigation was prompted by concerns from multiple parents who reported boys being allowed to use the girls’ restrooms.
