A female stunt performer has sued Kevin Costner over claims she was required to participate in a “violent unscripted, unscheduled rape scene” while filming the second installment of the award-winning actor’s four-part Western movie series, “Horizon: An American Saga.”
Devyn LaBella filed the lawsuit in the Los Angeles County Superior Court on Tuesday, accusing Costner and the film’s production companies of a host of complaints, including sexual discrimination and harassment, creating a hostile work environment, intentionally inflicting emotional distress, and breach of contract.
During the alleged May 2023 incident, LaBella claims she was asked to stand in for Ella Hunt after the actress refused to take part in the rape scene opposite actor Roger Ivens and walked off the set.
“[LaBella] was not warned or prepared for Mr. Ivens to perform or engage in any action on top of her and first learned that Ivens would mount her and violently pull her skirt up when he was already on top of her doing so,” the lawsuit reads.
“The impact of this impromptu work demand on Ms. Labella has been profound, not only upending a career Ms. Labella spent years building but leaving her with permanent trauma that she will be required to address for years to come.”
As a SAG-AFTRA member, LaBella’s agreement with the defendants, including Horizon Series Inc., Horizon Series 2 LLC, and Territory Pictures Inc., outlined “specific contractual obligations” for any nude and intimate scenes, the complaint states. These include having an intimacy coordinator present on set and obtaining prior written consent for the scene.
However, Costner’s lawyer, Marty Singer, told The Epoch Times via email that the scene in question was explained to LaBella ahead of time.
“After she performed the rehearsal in character with another actor, she gave her Stunt Coordinator supervisor a ‘thumbs up’ and indicated her willingness to then shoot the scene, if needed (which she was not),” Singer said, in part.
“Our client Kevin Costner always wants to make sure that everyone is comfortable working on his films and takes safety on set very seriously,” he said.
“However, this claim by Devyn LaBella has absolutely no merit, and it is completely contradicted by her own actions—and the facts.”
LaBella requested the court award her compensatory and punitive damages, as well as attorney’s fees. She has also asked that the defendants complete anti-sexual harassment and anti-sexual violence training and issue her a public apology.
In addition to starring in “Horizon,” Costner co-wrote, directed, and produced the series.
The first installment debuted in theaters on June 28, 2024. The second chapter, initially scheduled to premiere theatrically that August, was indefinitely postponed after the first film underperformed at the box office.
Release dates have not yet been announced for any of the coming installments.
