A U.S. Immigration and Customs Enforcement officer who was indicted for allegedly hitting a fleeing illegal immigrant with his car in Texas turned himself in on Monday.
ICE agent Mario Alberto Morales was charged with aggravated assault with a deadly weapon, in this case a motor vehicle, according to Harris County District Attorney Sean Teare. The incident happened on Oct. 10, and Morales was indicted Oct. 30.
The Harris County District Attorney showed video of the incident at the Oct. 30 press conference. Morales was following Miguel Parra Hernandez when Parra Hernandez got out of his car and tried to run away. Morales followed in his vehicle and hit Parra Hernandez, running over both of his legs, Teare alleged.
Teare said ICE was looking for another man who, according to news reports, had been dead for nine years. Parra Hernandez was an illegal immigrant who had been living in Harris County for more than 30 years and had no criminal record and did not have a deportation order.
“An ICE badge does not give you free rein to injure, kill, or violate the constitutional rights of anyone,” Teare said at the press conference.
He said that he hoped the case “sends a loud and clear message to every ICE officer who feels that they have a free pass to terrorize our streets, the time to stop is now. And if you don’t, you will be held accountable.”
U.S. Attorney Aaron Reitz of the Southern District of Texas said the case looked like a political prosecution. He made reference to a previous ICE-related shooting in Houston in his statement.
“Disappointed in his inability to swiftly bring charges in the tragic Salgado shooting in July, the Harris County District Attorney now appears determined to put a different federal agent’s scalp on the wall. This time, he’s pursuing what looks like a political prosecution of an ICE agent for doing his job—exactly what his allies have been agitating for,” Reitz said in an Oct. 30 statement.
“My office was not consulted or even notified before this indictment. The DA’s office never contacted us. That tells you something about the approach they’ve taken.”
Reitz said on Oct. 30 that based on the evidence he has reviewed, he would not bring federal charges against Morales at this time.
“Federal agents should not be turned into political trophies for doing the difficult and dangerous work of enforcing federal law,” Reitz said in a statement. “We stand with ICE and all our federal law enforcement partners.”
An ICE spokesperson denied that the ICE agent intentionally hit Parra Hernandez.
The Harris County District Attorney and Parra Hernandez’s attorney did not respond to emails seeking comment.
On July 7, Lorenzo Salgado Araujo, an illegal immigrant living in Texas, was shot and killed by an ICE agent.
According to the U.S. Attorney’s Office for the Southern District of Texas, ICE agents were looking for two men in a white van, and Salgado Araujo and another man fit that description.
ICE agents twice attempted to stop the white van, according to the U.S. Attorney’s Office’s preliminary account. The van fled the first attempt, and agents did not pursue it. When agents encountered the van again, its occupants again attempted to flee, but agents surrounded the vehicle. An officer was partially inside the van or immediately next to it when the driver shifted into reverse and then forward. During the confrontation, an officer fired a single shot that struck Salgado Araujo, who later died at a hospital.
